James Kainen

Professor Kainen holds the Brendan Moore Chair in Advocacy at Fordham University School of Law. He currently teaches Property, Evidence, Jurisprudence, and Legal Process at Fordham, where he has also taught American Legal History and Trial Advocacy. He is a graduate of Brown University and Harvard Law School. Before joining the Fordham Faculty, Professor Kainen was Associate Professor at the University of Miami School of Law and Assistant United States Attorney for the Southern District of New York in the Criminal Division. He also was litigation associate at Kreindler & Kreindler and Bernstein Litowitz Berger & Grossman, Assistant Professor in Law and Liberal Education at Brown University, and law clerk to United States District Judge Robert L. Carter. Professor Kainen has published in the areas of constitutional protection for property rights and criminal evidence. His publications include "The Historical Framework for Reviving Constitutional Protection for Property and Contract Rights," "Nineteenth Century Interpretations of the Federal Contract Clause: The Transformation From Vested to Substantive Rights Against the State," and "The Impeachment Exception to the Exclusionary Rules: Policies, Principles and Politics.
